Terms of Service
These Terms of Service set out the conditions under which the operator (“Operator”) of “Fret Days” (the “Service”) provides the Service. By using the Service, you agree to these Terms.
Article 1 (Application)
These Terms apply to all relationships between the Operator and users in connection with the use of the Service.
Article 2 (Definitions)
In these Terms, “Service” means the web application “Fret Days” provided by the Operator, including guitar practice logging and practice tools (metronome, drum patterns, looper, speed trainer, etc.); “User” means an individual who uses the Service; and “PRO plan (paid plan)” means the paid plan defined in Article 4.
Article 3 (Accounts)
- Users are responsible for managing their own accounts and must not allow third parties to use their login credentials.
- Registration information must be true and accurate.
- Impersonating others, using multiple accounts to unfairly gain benefits, or any other unauthorized use of an account is prohibited.
Article 4 (Fees and the PRO plan)
- The fee for the PRO plan is US$4.99/month or US$39.99/year (the amount shown is the full amount charged — no tax is added). If billed in a currency other than USD, the amount charged may vary with the exchange rate at the time of the transaction.
- The PRO plan includes a 7-day free trial, during which no charge is made. After the trial ends, the subscription automatically renews and is billed at each billing period (monthly or annually). The free trial only applies to a user's first sign-up.
- Users may cancel the PRO plan at any time. No charge is made if canceled during the free trial. If canceled after the trial ends, the PRO plan remains available through the end of the paid billing period. No prorated refunds are provided.
- The operator may revise the PRO plan fee. Except where urgent and unavoidable, any revision is announced on the Service at least 30 days in advance. The revised fee applies from the first renewal date that falls after the announcement. A user who does not accept the revised fee may cancel before that renewal date and will not be charged the revised amount.
Article 5 (Prohibited conduct)
Users must not engage in any of the following when using the Service:
- Acts that violate laws, regulations, or public order and morals
- Disassembling, decompiling, or otherwise reverse-engineering the Service's software
- Unauthorized access or otherwise placing an excessive load on the Service's servers or network
- Extracting, reproducing, or redistributing audio or video from YouTube videos embedded in the Service, in violation of that platform's terms
- Infringing the rights (including copyright) of other users or third parties
- Transmitting or redistributing audio data handled by features such as the looper to any third party outside the Service
- Impersonating another person
- Any other conduct the Operator deems inappropriate
Article 6 (Intellectual property)
Copyright, trademark rights, and other intellectual property rights relating to the Service belong to the Operator or to third parties holding legitimate rights. Rights to data such as practice logs entered by a user into the Service belong to the user. The specific handling of such data is governed by the separately defined Privacy Policy.
Article 7 (Disclaimer)
The Operator makes no express or implied warranty that the Service is free of factual or legal defects. The Service is provided “as is.” Except in cases of the Operator's willful misconduct or gross negligence, the Operator is not liable for damages arising from data loss or from outages, specification changes, or discontinuation of third-party services such as Supabase, Stripe, or YouTube. Where the Operator is liable for damages, such liability is limited to the total amount of fees the user paid for the Service in the preceding 12 months.
Article 8 (Suspension and account termination)
The Operator may suspend a user's use of the Service or delete their account without prior notice if the user:
- Violates any provision of these Terms
- Is found to have provided false information at registration
- Fails to pay PRO plan fees for a substantial period
- Is otherwise deemed by the Operator to be an inappropriate user of the Service
The Operator is not liable for any damages a user incurs as a result of measures taken under this Article.
Article 9 (Changes, suspension, or termination of the Service)
The Operator may change the content of the Service, or suspend, interrupt, or terminate all or part of it, without prior notice to users, when the Operator deems it reasonably necessary for system maintenance, bug fixes, or other operational reasons.
However, for material changes to, or discontinuation of, the free plan, the Operator will, except in cases of urgent necessity, give notice on the Service at least 30 days in advance.
Article 10 (Changes to these Terms)
The Operator may amend these Terms when deemed necessary. Amendments will be announced by posting the revised content on the Service, and the revised Terms take effect from the time of that posting.
Article 11 (Governing law and jurisdiction)
These Terms are governed by the laws of Japan. Any dispute arising in connection with the Service shall be subject to the exclusive agreed jurisdiction of the court having jurisdiction over the Operator's location as the court of first instance.
